Practice Focus
Mr. Poirier is a partner of Ellis Law Group LLP. He represents individuals, professionals and businesses in all aspects of litigation. His current practice focuses primarily on complex civil litigation in state and federal court, professional malpractice defense, high-end personal injury/wrongful death cases and banking law.
Mr. Poirier is admitted to practice before all Courts in the State of California, and the Federal District Court of California for the Eastern and Northern Districts, as well as the United States Court of Appeals, Ninth Circuit. He is a member of the California State Bar and the Sacramento County Bar Association.
Mr. Poirier was a former prosecutor with the Sacramento County District Attorney’s office where he prosecuted over 20 felony/misdemeanor jury trials and more than 75 felony/misdemeanor court trials.

Mr. Poirier is currently a Commander in the United States Naval Reserve having spent his military career in naval aviation and related areas. Representative Cases
- CAB, Inc. v. Robert James Designs (January 2010) Breach of Contract Defense. Plaintiff sought more than $50,000 in damages including attorney fees. Nonsuit granted in favor of Defendant client at the conclusion of Plaintiff’s case. Plaintiff ordered to pay portion of client’s attorney fees.
- Howard v. Great Expectations (September 2009) Commercial Law Defense. Participated in the Phase 2 trial of the consolidated class action representing defendant Great Expectations franchises throughout California. Favorable ruling obtained.
- Olsen v. Harbison (April 2008) Attorney Defense/Quantum Meruit/Fees/Alleged Wrongdoing by Attorney. Nonsuit granted in favor of client lawyer in pretrial motions on 4th day of trial.

- Kindice v. Corabel Lane Village Green Apartments et al (July 2007) Wrongful death/Negligence/Failure to Supervise Defense. Plaintiffs sought damages in excess of $5,000,000 from Defendant client. Case settled prior to trial, with client paying $1,500,000.
- Stoneridge Homeowner’s Assn. v. De Anza Properties et al (March 2007) Construction Defect/Nuisance/Breach of Contract Defense. Plaintiffs and Cross-complainants sought damages in excess of $10,000,000. Defense verdict rendered in favor of Defendant client after jury trial.
- Delich v. Mr. Cabinet (January 2007) Commercial Lease/Breach of Contract Defense. Cross-complainant sought damages in excess of $200,000. Case settled prior to trial, with client paying no monetary damages.
- Stevens v. Harvey et al (December 2006) Legal Malpractice Defense/ Negligence/ Breach of Fiduciary Duty/Conversion. Plaintiffs sought damages in excess of $1,000,000. Case dismissed prior to trial, with clients paying no monetary damages.
- Masters v. Roberts (February 2005) Legal Malpractice Defense. Defended legal malpractice action with partner Mark Ellis. At trial plaintiff sought damages from attorney client in excess of $1,500,000. Case settled prior to jury selection for less than $50,000.
- Pryor v. Fanny Ann’s Saloon (September 2004) Personal Injury Defense. Plaintiff sought damages in excess of $100,000. Case dismissed prior to trial, with client paying no monetary damages.
- Wells Fargo v. Remedios (June 2004) Commercial/Banking Law Defense. Defended violation of privacy rights/breach of contract action. Plaintiff sought damages in excess of $500,000. Prior to trial, case was dismissed by the court with client paying no monetary damages.
- Bernal v. Lockshin (May 2003) Legal Malpractice Defense. Legal malpractice action dismissed against attorney client. Cross-complaint settled in favor of client attorney on the fee cross-claim in excess of $500,000.
- Caporusso v. Lockshin (May 2003) Legal Malpractice Defense. Legal malpractice action dismissed against attorney client. Cross-complaint settled in favor of client attorney on the fee cross-claim in excess of $100,000.
- Miller v. Lockshin (April 2003) Legal Malpractice Defense. Legal malpractice action dismissed against attorney client. Cross-complaint settled in favor of client attorney on the fee cross-claim in excess of $100,000.
- Holesapple v. S. & H. (November 2002) Legal Malpractice Defense. Action dismissed against attorney clients. Settlement in favor of client attorneys on the fee cross-claim in excess of $450,000.
- Wells Fargo v. Sparks: (May 2001) Fraud/Conversion. Prosecuted case on behalf of client with partner Mark Ellis. Prior to trial, defendant entered into a stipulated judgment for damages in excess of $1,600,000.
- Hassan v. Kissilowicz (January 2001) Breach of contract/fraud defense. Plaintiff sought damages in excess of $1,000,000. Case settled prior to jury trial, with defendant client paying no monetary damages.
